DATA DISAGGREGATION CAN SERVE AS A POWERFUL TOOL IN TRACKING THESE DEMOGRAPHIC CHANGES, ALLOWING US TO GAIN VALUABLE INSIGHT INTO OUR POPULATION. HOWEVER, WHEN THEY RAISED THOSE TAXES, I, AS WELL AS MANY OTHER PEOPLE WITHIN THE SOUTHERN TIER, STOPPED GOING TO THOSE MARKETS AND STARTED GOING TO OTHER MARKETPLACES. IT'S NOT AS SIMPLE AS JUST GOING TO THE GAS STORE AND BUYING GASOLINE. THAT'S NOT JUST A SIMPLE COMMODITY. THE PRODUCTION OF GAS STARTS OUT WITH THE REFINERY STEPS AND THEN GOES THROUGH A TRANSPORTATION FROM THE REFINERIES TO THE TERMINALS, AND THEN THE BULK PLANTS AND, FINALLY, TO WHAT WE ALL TYPICALLY GO TO WHICH IS A GASOLINE SERVICE STATION. THE NEIGHBORHOOD SERVICE STATION MAY BE OWNED OR OPERATED BY AN INTEGRATED OIL COMPANY, A BRANDED OR UNBRANDED 71 NYS ASSEMBLY JUNE 3, 2019 REFINER, AN INDEPENDENT MARKETER/DISTRIBUTOR, A CHAIN RETAILER, A CONVENIENCE STORE OR AN INDEPENDENT SERVICE STATION DEALER. SO, THOSE ARE SEVEN DIFFERENT COMBINATIONS THAT YOU MAY HAVE AT -- AT A BASIC LEVEL. THE GASOLINE IN THE STATIONS' PUMPS MAY BE BRANDED OR UNBRANDED, MAY BE SUPPLIED DIRECTLY BY A REFINER OR BY AN INDEPENDENT MARKETER. THERE ARE FOUR MORE POSSIBILITIES TO COUPLE INTO THE SEVEN PREVIOUS TO GIVE YOU A VERY DIVERSE MARKET WITHIN OUR GASOLINE ECONOMY AT THE GAS STATION. JUST TO GIVE YOU A COUPLE OF EXAMPLES OF HOW THAT MIGHT WORK OUT, YOU MAY HAVE THE OIL COMPANY OR THE OIL REFINER WHO OWES -- OWNS AND CONTROLS RETAIL PROPERTY AND THEN LEASES TO A SMALL BUSINESS OWNER. GASOLINE IS SOLD TO THE DEALER AT A PRICE DETERMINED BY THE OIL COMPANY OR REFINER, AND THIS PRICE IS CALLED THE DEALER TANK WAGON AND IT'S CONSIDERABLY HIGHER THAN THE REFINER SELLS TO DISTRIBUTORS AT THE RACK PRICE. DEALERS PURCHASE GASOLINE AT FULL TRUCKLOADS OF $8,500 AND MANAGE THEIR OWN INVENTORY. DEALERS SET THE RETAIL PRICE ON THE PUMP, AND THIS IS DETERMINED BY LOCAL MARKET COMPETITION. THE EMPLOYEES AT THIS LOCATION ARE ALL EMPLOYED BY THE DEALER, AND THE TRADITIONAL GASOLINE SERVICE STATION HAS TWO TO THREE SERVICE BAYS TO DO AUTO REPAIRS AND TO HELP TO BRING IN OTHER MONEY INTO 72 NYS ASSEMBLY JUNE 3, 2019 THE MARKET. A SECOND SCENARIO IS ANOTHER TRADITIONAL GASOLINE SERVICE STATION PROPERTY THAT MAY BE OWNED BY A DISTRIBUTOR OR JOBBER, IT'S LEASED AND FRANCHISED TO THE DEALER WHO IS A SMALL BUSINESS OWNER. THERE'S A PROPERTY RENTAL AGREEMENT AND SUPPLY FRANCHISE AGREEMENT. GASOLINE IS SOLD TO THE DEALER AT A PRICE TO BE DETERMINED BY THE DISTRIBUTOR OR JOBBER. THIS PRICE IS CALLED, AGAIN, THE "DEALER TANK WAGON PRICE" AND, AGAIN, CONSIDERABLY HIGHER THAN THE RACK PRICE. A TRADITIONAL GASOLINE SERVICE STATION PROPERTY MAY BE OWNED AND OPERATED BY AN OIL -- OIL COMPANY OR REFINER. THE FRANCHISE IS OWNED BY THE DISTRIBUTOR AND WORKERS ARE EMPLOYED BY THE DISTRIBUTOR OR JOBBER. GASOLINE IS DELIVERED TO THE STATION AS NEEDED, AND IS THE PROPERTY OF THE DISTRIBUTOR. THE OIL COMPANY REFINER SETS THE RETAIL PRICE AT THE PUMP. SINCE REFINERS CONTROL THE RACK PRICE, PRICES AT THE PUMP ARE USUALLY MORE COMPETITIVE THAN OTHER RETAIL LOCATIONS THAT REQUIRE DEALERS TO PAY A HIGHER WHOLESALE PRICE. THE DEALER TANK WAGON -- TANK WAGON PRICE, AND ALSO MUST ADD A MARKUP FOR PROFIT. REFINERS THAT OWN RETAIL -- RETAIL LOCATIONS AND OPERATE THEM ARE A DYING BREED. 73 NYS ASSEMBLY JUNE 3, 2019 SO, THOSE ARE JUST A COUPLE EXAMPLES OF THE DIVERSITY THAT WE HAVE WITHIN OUR GASOLINE STATIONS WITHIN THE STATE. AND IT'S NOT JUST AS SIMPLE AS GOING TO A GAS STATION AND BUYING GAS LIKE BUYING -- BUYING AN ORANGE OR AN APPLE. IT'S VERY DIFFERENT, AND THOSE INDIVIDUALS THAT OWN, LEASE, EMPLOY INDIVIDUALS OR NEED TO HAVE A CONVENIENCE STORE OR SOMETHING ELSE HAPPENING AT THAT LOCATION TO BRING IN MONEY DO THAT BECAUSE OF THE WAY THEY'VE SET UP THEIR BUSINESS. AND THAT'S ONE OF THE GREAT THINGS ABOUT AMERICA, IS THE FREE MARKET AND HAVING SO MANY OPPORTUNITIES FOR THIS DIVERSITY. SO, I HAVE A STUDY THAT WAS DONE BY THE QUINNIPIAC BACK IN ABOUT 2007, 2008, AND THEY DID A STUDY THAT WAS VERY SIMILAR TO WHAT WE'RE TRYING TO HERE TODAY. AND WHAT THEY FOUND IS THAT IF WE WERE TO EMPLOY THIS RATE, THAT PRICE -- GAS PRICES WOULD ACTUALLY GO UP. AND I DON'T THINK THAT'S WHAT ANYBODY IN THIS ROOM WOULD LIKE TO SEE HAPPEN. I HAVE LETTERS IN OPPOSITION FROM NFIB, THE BUSINESS COUNCIL, WHICH I WILL READ A PORTION OF THAT. FROM THE BUSINESS COUNCIL, THEY SAY, "THIS BILL WOULD AMEND THE GENERAL BUSINESS LAW BY PROHIBITING THE ESTABLISHMENT OF ZONE PRICING OF GASOLINE. THE BILL ASSUMES THAT PRICES SET ACCORDING TO ZONES ARE ARBITRARILY BASED ON WHAT COMPANIES ASSUME CONSUMERS ARE LIKELY TO PAY, OR THE EFFECT IS TO INJURE COMPETITION. IN ESSENCE, THE BILL'S INTENT IS TO SUBVERT MARKET PRICING THAT ALLOWS A FLEXIBILITY TO COMPLETE. ZONE OR MARKET-BASED PRICING IS BASED ON THE REALITY THAT COMPETITION IS LOCALLY DRIVEN, IT VARIES FROM MARKET TO MARKET AND FLUCTUATES OVER PERIODS OF TIME, AS ZONE PRICING ALLOWS LOCAL SELLERS TO COMPETE BASED ON THE CONDITIONS WITHIN THEIR 74 NYS ASSEMBLY JUNE 3, 2019 LOCAL MARKETS. THESE MARKETERS ARE DRIVEN BY THE COMPETITION THEY FACE AND THE REACTIONS OF THE CONSUMERS. IT IS THIS MARKET-BASED PRICING THAT ALLOWS THE GASOLINE INDUSTRY TO COMPETE." AND THEY'RE THE ONES THAT GO ON AND THEY -- THEY ALERTED ME TO THE EXISTING LAW WHERE THEY SAID THEY BELIEVE THE EXISTING LAW, SECTION 396-R OF THE GENERAL BUSINESS LAW IS ADEQUATE AND APPROPRIATE TO ADDRESS PRICE GOUGING. IT GIVES THE ENFORCEMENT AUTHORITY TO THE STATE'S ATTORNEY GENERAL, ALLOWS FOR INJUNCTIVE RELIEF, CIVIL PENALTY UP TO $25,000, AS WELL AS COURT-ORDERED RESTITUTION TO AGGRIEVED CONSUMERS. AND THEN I HAVE ANOTHER OPPOSITION LETTER FROM THE INDEPENDENT PETROLEUM MARKETERS OF NEW YORK. THEY -- THEY SAY THAT "CURRENTLY UNDER NEW YORK STATE LAW, THE OFFICE OF THE ATTORNEY GENERAL ALREADY HAS THE ABILITY TO PURSUE ACTIONS IN ZONE PRICING AT PETROLEUM INSTANCES. ALLOWING FOR A SEPARATE PRIVATE RIGHT OF ACTION WILL OPEN THE DOOR TO COUNTLESS FRIVOLOUS LAWSUITS IN THE ALREADY OVERBURDENED CRIMINAL JUSTICE SYSTEM AGAINST INDEPENDENT MARKETERS IN NEW YORK STATE. THE NUMBER OF INDEPENDENT NEW YORK-BASED GAS STATIONS AND STORES ARE ALREADY IN DECLINE. IN 1972, 47 YEARS AGO, THERE WERE 11,359 RETAIL GASOLINE OUTLETS THAT SERVED THE CONSUMERS OF THE STATE. THERE ARE ONLY APPROXIMATELY 5,863 OUTLETS THAT HAVE MANAGED TO KEEP THEIR DOORS OPEN. AS RESPONSIBLE SMALL BUSINESS OWNERS, THE INDEPENDENT PETROLEUM MARKETERS ARE NOT RESPONSIBLE FOR GASOLINE PRICING SPIKES IN THE MARKET. WE URGE STATE GOVERNMENT OFFICIALS TO RECOGNIZE THAT PRICING -- PRICING POLICIES ARE DRIVEN BY BOTH COUNTRIES 75 NYS ASSEMBLY JUNE 3, 2019 FAR DISTANT FROM OUR SHORES AND/OR MULTINATIONAL CORPORATIONS, AND TO STOP PERSECUTING SMALL BUSINESS PEOPLE WHO WORK, PAY TAXES AND HIRE CITIZENS IN NEW YORK STATE." THEY RESPECTFULLY REQUEST CONSIDERATION OF THEIR CONCERNS AND URGE THE OPPOSITION TO THIS LEGISLATION. THEY ARE QUITE CORRECT WHEN THEY SAY THAT THEY DO NOT CONTROL THE PRICES OF GASOLINE. IF WE REALLY WANT TO GO AHEAD AND MAKE CHANGES, ESPECIALLY IN TIMES OF CRISIS, A BETTER APPROACH MIGHT BE TO DO SOMETHING TO PRIVATELY -- OR TEMPORARILY HALT THE SALES -- OR COLLECTION OF SALES TAX DURING A TIME OF CRISIS. NEW YORK IS THE FIFTH HIGHEST IN -- IN STATE TAXES WHEN IT COMES TO GASOLINE. PENNSYLVANIA IS NOW THE HIGHEST AT 58.7 PERCENT -- 58.7 CENTS, AND THAT WAS ONLY DONE A FEW YEARS AGO WHEN THEY'VE SEEN A DIRECT DECLINE AT THE NUMBER OF PEOPLE THAT WOULD GO ACROSS THE STATE BORDER TO PURCHASE GASOLINE THERE. CALIFORNIA IS NUMBER TWO; WASHINGTON, NUMBER THREE; HAWAII, NUMBER FOUR; NEW YORK, NUMBER FIVE AT 45.76 CENTS A -- CENTS PER GALLON. THAT WOULD BE AN IMMEDIATE HELP DURING A TIME OF CRISIS, TO HALT THOSE -- THOSE TAXES FOR A TEMPORARY PERIOD OF TIME, AND THAT WOULD HELP DURING THOSE -- THOSE PERIODS, INSTEAD OF HURTING OUR SMALL BUSINESS AND FURTHER DRIVING OUT SMALL BUSINESS FROM WITHIN THE STATE.
